About the Role

Phoenix Legal Solicitors is seeking a seasoned Clinical Negligence Solicitor to become a key part of our growing team based in Birkenhead, Wirral. The firm specializes nationally in personal injury, medical negligence, and severe injury claims, dedicated to securing justice for affected individuals by providing compassionate and expert legal assistance.

This position offers a remarkable opportunity for an experienced clinical negligence lawyer to independently manage a high-quality caseload and contribute significantly to the expansion of our Clinical Negligence department.

Key Responsibilities

• Proactively oversee your own clinical negligence caseload from initial investigation through to settlement or litigation.
• Evaluate liability, causation, and quantum, crafting effective case strategies accordingly.
• Gather and scrutinize medical records and other pertinent evidence.
• Identify and instruct suitable medical experts and legal counsel.
• Prepare legal documents including Letters of Claim, witness statements, and schedules.
• Negotiate settlements and advise clients on offers received.
• Initiate and manage court proceedings when necessary.
• Monitor and comply with limitation periods, court deadlines, and procedural requirements.
• Maintain detailed and accurate case files along with time recording.
• Handle cases with commercial insight, considering proportionality, costs, and likelihood of success.
• Provide clients with clear, compassionate, and practical advice throughout their claims process.
• Collaborate effectively with colleagues to ensure cases progress efficiently and clients receive excellent service.
• Offer technical guidance and mentorship to junior team members as appropriate.
• Contribute to the growth and development of the Clinical Negligence department and the firm overall.

Candidate Profile and Requirements

• A minimum of 5 years Post Qualification Experience (PQE) or equivalent in clinical or medical negligence law.
• Demonstrated ability to independently manage a clinical negligence caseload.
• In-depth understanding of clinical negligence litigation, including relevant Civil Procedure Rules and pre-action protocols.
• Experience assessing liability, causation, and quantum in clinical negligence claims.
• Skilled in instructing medical experts and counsel.
• Proficient in negotiating settlements and advancing litigated cases.
• Exceptionally strong drafting and written communication skills.
• Highly organised with effective time-management capabilities and keen attention to detail.
• Sound commercial awareness and understanding of claimant litigation economics.
• Ability to manage multiple deadlines and drive cases forward with initiative.
• Outstanding client-care abilities, especially when supporting vulnerable clients or those with life-altering injuries.
• Comfortable working independently and collaboratively within a team.
• Willingness and aptitude to share knowledge and support junior colleagues.
• Experience with complex or high-value clinical negligence claims, including catastrophic injury cases, is highly desirable.
