Construction Lawyer

About the Role

A well-established and expanding legal practice in Melbourne is seeking a skilled Construction Lawyer to join their team. This position offers the chance to collaborate with seasoned specialists in construction law, providing legal advice to a wide variety of clients such as builders, developers, contractors, subcontractors, consultants, property owners, and other participants in the construction sector.

The role encompasses a diverse range of construction-related legal matters, both at the initial contract stage and in dispute resolution phases. You will have the responsibility to manage case files, engage directly with clients, and advance your professional growth within a supportive team environment.

Primary Responsibilities

• Drafting, evaluating, and negotiating construction, consultancy, and subcontractor agreements.
• Providing advice regarding contract administration issues including variations, extensions of time, delay claims, and contractual notices.
• Offering guidance on Security of Payment laws, including payment claims, schedules, and adjudications.
• Handling disputes within the building and construction industry.
• Advising clients on defective work, statutory warranties, and insurance claims.
• Preparing legal documents such as pleadings, affidavits, witness statements, submissions, and documents for court or tribunals.
• Coordinating with experts and legal counsels as required.
• Representing clients in negotiation sessions, mediations, and settlement conferences.
• Making appearances in Victorian Civil and Administrative Tribunal (VCAT) and assisting with court proceedings in Victorian courts.
• Managing case files and maintaining direct client relationships.

Required Qualifications and Skills

• At least two years of experience post-admission in building and construction law.
• Experience in both construction disputes and front-end construction legal matters, or in any combination thereof.
• Familiarity with the Domestic Building Contracts Act 1995 (Victoria) and Security of Payment legislation.
• Proficiency in drafting, negotiation, and legal research.
• Capability to independently manage legal matters.
• Exceptional written and oral communication skills.
• A practical, commercially oriented perspective in advising clients.
• Great attention to detail and an ability to balance multiple priorities effectively.

Preferred Experience

• Prior experience representing builders, developers, contractors, subcontractors, or property owners is considered advantageous.
